What Is a BOC-3?
A BOC-3 (Designation of Process Agents) is a federal filing that names a process agent in every state where you operate. A process agent is the person authorized to accept legal documents on your behalf if someone files a lawsuit against your company.
The FMCSA requires an active BOC-3 on file before your MC or FF number can activate, and for as long as you hold it. It is a small filing, but if it lapses it can shut down an entire operation.
What Happens After I Order?
We collect your company details and file your BOC-3 electronically with the FMCSA the same day. It attaches to your authority record immediately, and you get confirmation for your files. From then on you're covered for life: no renewals, and free amendments whenever your name or address changes.
Frequently Asked Questions
Can I be my own process agent?+
Only in states where you have a physical office. For all other states, you need a designated agent. A blanket filing like ours covers you everywhere with one form.
How fast is the filing?+
We file electronically. Your BOC-3 shows up on your FMCSA record within minutes of filing.
Do I need to renew my BOC-3 every year?+
Not with us. Our BOC-3 filings are lifetime. Some other companies charge annual fees. We don't.
Who needs a BOC-3?+
Every motor carrier, freight broker, and freight forwarder with FMCSA operating authority. Your MC or FF number will not activate without one on file.
When should I file it?+
As soon as your authority is generated. The BOC-3 and your insurance are the two things that must be on file before the FMCSA's waiting period can end and your authority can activate.
What happens if my BOC-3 is removed?+
Your operating authority will be revoked. The FMCSA requires an active BOC-3 on file to maintain your MC or FF number. If that has already happened, our reinstatement service gets you active again.
What happens if my company information changes?+
Your BOC-3 must be amended to include the new information, otherwise it will be removed. Some companies force you to pay for another BOC-3. We amend it for free, and remember to update your MCS-150 too.
