A BOC-3 (Designation of Process Agents) is required by the FMCSA for all for-hire motor carriers, freight brokers, and freight forwarders operating under interstate authority (MC or FF Number).

It designates a process agent in every state to accept legal documents on your behalf. Without a BOC-3 on file, your Carrier, Broker, or Freight Forwarder authority cannot be activated.

Who Needs a BOC-3?

You need a BOC-3 filing if you're applying for or currently hold:

  • Motor carrier authority (MC number) for hauling freight or passengers

  • Broker authority (MC number) for arranging freight to be carried

  • Freight forwarder authority (FF Number) for break-bulk / consolidation of shipments

In summary, if you have an authority in addition to your DOT number, you need a BOC-3. Private carriers who only haul their own goods and anyone else that doesn’t have an MC or FF authority do not need a BOC-3 filing.

If you've already applied for authority, the FMCSA will automatically dismiss your application after 90 days if you haven't filed proof of insurance and a BOC-3. If your BOC-3 is removed from your authority for any reason, your authority will be revoked unless a replacement is filed.
