What is a Clearinghouse Query?
Employers must check the FMCSA Clearinghouse to see if a CDL driver has any drug or alcohol violations on record. There are two types: limited queries show whether violations exist (yes or no), and full queries show complete violation history but require driver consent.
Frequently Asked Questions
When are queries required? Pre-employment queries are required before a CDL driver performs any safety-sensitive functions. Annual queries are required at least once every 12 months for each current CDL driver.
What if a driver has a violation? You cannot hire or continue to employ a driver with an unresolved violation. They must complete the return-to-duty process with a Substance Abuse Professional before returning to safety-sensitive duties.
Can I run queries myself? Yes, if you have an employer Clearinghouse account. Our service handles it for you so you do not have to log in and manage it yourself.
What's the difference between limited and full queries? Limited queries show whether a violation exists but not the details. If a limited query comes back with a violation, you must run a full query (which requires driver consent) to see the details. Pre-employment queries are ‘full’ and annual queries are ‘limited’.
